Spilman served as lead trial counsel in an insurance defense matter that involved two plaintiffs bringing suit against multiple defendants for an alleged conspiracy to sell them disability insurance on their mortgage loan and alleged harassment of those two plaintiffs to pay the delinquency in their loan payments after they claimed to be disabled and claimed that the disability policy should make their payments. The plaintiffs bifurcated their case, proceeding against our clients in court and proceeding against the other defendants in arbitration. This matter was important because it was the first time, to our knowledge, where any defendant took this type of matter to a jury trial instead of merely settling the case. It also was important because the plaintiffs were alleging that all defendants were in an international conspiracy with entities in other countries to defraud the plaintiffs, and the plaintiffs made a seven-figure settlement demand. Spilman secured a complete defense verdict for our client, and the plaintiffs were awarded nothing.
