Spilman Represents O&G Association on AST Regulations
Spilman represented an oil and gas industry trade association before the West Virginia Legislature in connection with bills introduced to require registration and regulation of 50,000 aboveground storage tanks (ASTs). Drafted amendments and lobbied to mitigate the impact of Senate Bill 373 on the oil and gas industry. Drafted multiple comments on proposed rules implementing SB 373 and worked with the West Virginia Department of Environmental Protection to limit duplicative and unnecessary regulatory requirements. Developed legislative substitute for SB 373 and promoted adoption of same during 2015 Regular Session. Senate Bill 423 dramatically reduced the regulatory scope of the legislation on oil and gas, and other AST owners. Drafted comments to proposed rules implementing SB 423. Filed appeal to Environmental Quality Board (EQB) challenging delineation of regulatory zones of concern.
