Mr. Shumway’s primary area of practice is litigation.
Experience
- Experience assisting clients with non-immigrant visa applications, asylum applications, and advising companies and educational institutions on immigration-related issues.
- Emphasis in commercial litigation, toxic torts, product liability, Federal Black Lung, and appellate litigation
- Representing anywhere from local businesses to Fortune 500 companies in all phases of litigation, including drafting pleadings, drafting dispositive and evidentiary motions, conducting discovery, taking and defending depositions, participating in hearings, and conducting trial preparation and trial support
- Defending employers in litigation related to Federal Black Lung claims
- Briefing appeals before the Supreme Court of Appeals of West Virginia, the U.S. Court of Appeals for the Fourth Circuit, and the United States Department of Labor Benefits Review Board
- Experience litigating cases in West Virginia state court; the U.S. District Court for the Southern District of West Virginia; the U.S. District Court for the District of Delaware (as visiting counsel); and before the United States Department of Labor
