Pennsylvania Update: Guidance Issued for Businesses as 24 Counties Move to the Yellow Phase of the Reopening Plan

Governor Wolf has selected 24 counties for movement from the red phase to the yellow phase of the reopening plan. Once a business is permitted to open in-person operations, they must comply with certain requirements that are set forth in a guidance document available here.
 
The Guidance references certain orders and documents issued by the PA Department of Health, PA Department of State and Governor's Office. In addition to the referenced items, additional requirements are imposed on businesses, including the posting of the "COVID-19 Safety Procedures for Businesses" flyer.
 
Businesses must sign and post the flyer in employee common space and, if the business serves the public, the business must also post the flyer near the business’s public entrance(s). Businesses must sign the flyer to acknowledge that the owner or management is aware of the COVID-19 safety procedures and understands the responsibility to comply with the Guidance. The flyer must be signed by the business’s corporate officer, site manager, site foreperson, or equivalent.
 
The flyer also contains a space for the business to indicate the employee who has been designated as the “Pandemic Safety Officer,” or the person in charge of the COVID-19 safety procedures for the business. The signed acknowledgement and Pandemic Safety Officer designation should not be returned to the Commonwealth – it must be posted and available if requested by local law enforcement.
 
The Guidance also contains specific limitations for businesses that serve the public.
