The Spilman team recently won a case on all counts, including fraud and unfair and deceptive trade practices, for our client, a North Carolina-based trucking company. The trial lasted two weeks, and involved our client as plaintiff and a larger transportation company as defendant. The lawsuit was over fraudulent overcharging to our client in the purchase of its trucking fleet from the defendant at the conclusion of a four-year lease. The purchase occurred in 2009, and the team was able to overcome significant statute of limitations defenses. The verdict was for the full amount that was overcharged, and the team will now seek to have the verdict trebled and attorneys' fees awarded.
